Please read the Terms and Conditions (“the Terms”) carefully before placing any orders on atmos-KL.com and/or using this website (“the Website”). By accessing the Website, you agree to be bound by the Terms which may be updated from time to time without notice.
The Terms stated herein constitute a legally binding agreement between you and Atmos Malaysia Sdn. Bhd., a company incorporated under the laws of Malaysia. (“atmos KL”, “we”, “us”, “our”).

PLACING YOUR ORDER

Upon placing your order, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it. Acceptance of your order and the formation of a contract of sale of the product(s) between you and us will not take place unless and until full payment is provided and upon you receiving a confirmation from us that the product(s) have been shipped to you from our warehouse.

All products shown on the Website are subject to availability. Although we strive to ensure the Website accurately reflects the available stock, a product displayed on the Website may no longer be available.

In the event of conflicting purchases due to insufficient stock, atmos KL has the right to forfeit any customer of the purchase. We will inform you by way of email and proceed to refund any payment(s) made.

REQUIREMENTS TO CONTRACT WITH ATMOS KL

You must be 18 years of age or older to buy products via the Website. If you are below 18 years of age, you must obtain consent from your parent(s) or legal guardian(s).

By consenting to your acceptance of the Terms, your parent(s) or legal guardian(s) are agreeing to take responsibility for: (i) your actions in your use and/or access of our Website; (ii) any charges associated with your use and/or access of our Website; and (iii) your compliance with the Terms. If you do not have consent from your parent(s) or legal guardian(s), you must cease to use and/or access our Website.

You can only order through our Website if you are a consumer, not a reseller.

You guarantee that the information you provide to us in any order is accurate, current, and complete in all respects.

The following applies to all types of products sold on the Website. All information on the Website is an invitation to treat only; The information is not an offer or a binding contract. By placing your order, you are offering to purchase a product on and subject to the Terms.

All orders submitted are subject to availability and confirmation of acceptance by us. We reserve the right to verify an order in advance at all times and may refuse to accept an order without providing reasons and with no liability to you or any third parties.

We may choose not to accept your order at our sole discretion. Below are situations where we may not accept your order:

1. Where the Product(s) are shown on the Website but are not or no longer available;
2. Where the Product(s) displayed on the Website contains a manifest error such as being incorrectly priced or otherwise incorrectly described;
3. Where we are unable to obtain authorization for payment or the payment process is incomplete.

We reserve the right to cancel your order after the creation of the contract of sale, thereby terminating the contract of sale. Following such cancellation, we will provide a full refund of the amount paid under the cancelled order.

All Product(s) sold through our Website shall remain the property of atmos KL until you have paid all amounts owed to us in full under any contract of sale. You may not sell, dispose of or encumber any Product(s) before full title thereof has passed to you.

atmos KL has and fully reserves the right to refuse to accept any order that, it knows or reasonably suspects, was made with the assistance or involvement of any software, robot, crawler, spider or other automated means or device.

 

DEVIATIONS

We reserve the right to possible typographical errors relating to the product description, pricing, and availability. Minor differences in colour and other variations in the product(s) are possible as a result of different image acquisition, display technologies or other technical reasons.  

We may cancel an order where the product(s) displayed on the Website contains a manifest error (i.e. incorrect pricing/product description) and/or an incorrect stock balance.

We reserve the right to invoke force majeure in situations where we are prevented from delivering the product(s) due to circumstances beyond our or our suppliers’ control (for example, in the event of a war, extreme weather conditions, power or network outages, work strike or blockade). In such situations, we shall have the right to postpone the fulfilment of the delivery. We will promptly notify you by way of email of the obstacle directly and how it affects the ability to perform according to the agreement. If such notice is not given within a reasonable time after we have become aware of or ought to have become aware of the obstruction, we are obliged to pay compensation for the damage that you could have avoided if the notice was delivered in a timely manner.

 

MISUSE OF THE WEBSITE

You are prohibited from using any software, robot, crawler, spider, page scraper or any other automated means or device to (a) access, copy, affect or monitor any part of the Website or its content or circumvent the structure or presentation of the Website or any of its content or (b) to interfere with the operation of the Website or any transaction being made on the Website or interfere or affect any person’s use of the Website or to help facilitate any third party to purchase any product on the Website.

 

GOVERNING LAW

These Terms of use shall be governed by and construed in accordance with the laws of Malaysia. Any dispute which may arise under these Terms shall be under the exclusive jurisdiction of the Courts of Malaysia.

 

ONLINE RAFFLE

Terms and Conditions

By entering the Raffle, you hereby agree to these Terms and Conditions:

All Raffles take place online on our Website (raffle.atmos-kl.com).

Customers must have a valid shipping address and a registered email address on the Website (atmos-kl.com).

Each customer is limited to a single entry per launch product; Any duplicate entries will be disqualified from the Raffle.

Any request to amend entry details and/or cancel of Raffle entry will not be entertained. 

Upon being selected as the Raffle winner, your payment will automatically be captured.

A Shipping fee of RM20 will be charged for all Raffle products.

Please note that due to its nature, participating in any of our Raffles, customers are not guaranteed to purchase the Raffle product. Additionally, the customer’s opportunity to purchase any Raffle product is subject always to stock availability.

Raffle entries can’t be sold, transferred, assigned or otherwise provided to anyone else and do NOT hold any cash value and are not redeemable for cash or for credit towards any purchase. Evidence of such behaviour by any account holder will result in disqualification and account deactivation.

Vouchers and discounts are not applicable to any Raffle products.

Upon entering the Raffle, funds will be HELD and payment is authorized by you.

You are acknowledging that the money will be unavailable to you and shall remain pending upon entering the Raffle.

Our contract with you is only entered upon payment being captured and upon receipt of an email confirming that the product(s) has been shipped from our warehouse.

Payment will only be captured if you are one of the winners of the Raffle. All unsuccessful entries will have their payment released/cancelled after the draw closes. Funds may take up to 30 days to appear back into your account depending on the card company involved.

Please contact your respective bank regarding the status of the refund and/or any issues arising thereof.

All entries will be randomly drawn. When the draw closes, customers will be notified by email whether their entry was successful within 48 hours.

The Raffle closing date is subject to change at any time at Atmos Malaysia Sdn. Bhd. (atmos-kl.com) sole discretion.

All sales for Raffle items are FINAL. No amendments or size exchanges for Raffle products. No refund or cancellation will be entertained.

Entering the Raffle gives Atmos Malaysia Sdn. Bhd. (atmos-kl.com) the right to create an order and capture your payment upon the selection of the winners.

Atmos Malaysia Sdn. Bhd. (atmos-kl.com) reserves the right to cancel a successful transaction upon the occurrence of any of the following events:

• Stock inventory issue
• Product quality issue

Atmos Malaysia Sdn. Bhd. (atmos-kl.com) reserves the right to disqualify any customer that is found to be tampering with the entry process or operation of entering the draw or acting in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner.
